Terms and Conditions for the TrustMark Certification Program
Eligibility:
- Clients must meet the initial inspection criteria set by TrustMark to receive certification.
Certification Maintenance:
- The client is required to maintain the standards of cleanliness, service quality, and safety as outlined during the inspection.
- TrustMark reserves the right to conduct regular and surprise inspections to ensure compliance.
Non-Compliance:
- If the client fails to maintain the required standards, TrustMark reserves the right to revoke the certification without prior notice.
- Upon revocation, the client must immediately remove the TrustMark display board and cease any use of the certification in marketing or promotional materials.
No Refund Policy:
- Certification fees are non-refundable under any circumstances, including revocation due to non-compliance.
Access for Inspection:
- The client must grant TrustMark authorized personnel access to the premises for periodic inspections as part of the program requirements.
Use of Certification:
- The TrustMark certification and associated materials (e.g., display board, logo) remain the property of TrustMark and are licensed to the client for use during the valid certification period.
Termination:
- TrustMark reserves the right to terminate the certification agreement and remove the client from the registered list if the standards are not upheld.
- The client agrees to bear any costs associated with the removal of TrustMark materials from their premises.
Liability Disclaimer:
- TrustMark is not liable for any business losses, damages, or disputes arising from the revocation or termination of certification.
Amendments:
- TrustMark reserves the right to modify the terms and conditions at any time. Changes will be communicated to clients, and continued participation in the program constitutes acceptance of the revised terms.
Governing Law:
- This agreement is governed by the laws of Sri Lanka. Any disputes shall be resolved under the jurisdiction of the courts in Sri Lanka.
By participating in the TrustMark Certification Program, the client acknowledges and agrees to these terms and conditions.
